1. Agreement to Terms

By accessing or using LandlordOne ("Service", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

LandlordOne is a cloud-based property management platform that enables landlords and property managers to manage their rental properties, tenants, leases, maintenance requests, and financial records. The Service includes web-based tools for property tracking, tenant management, rent collection tracking, maintenance ticketing, and reporting.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

  • You are responsible for safeguarding the password that you use to access the Service.
  • You agree not to disclose your password to any third party.
  • You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • You may not use as a username the name of another person or entity that is not lawfully available for use.

4. Subscription and Billing

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis, either monthly or annually, depending on the type of subscription plan you select.

  • Free Trial: We may offer a free trial period. At the end of the trial, your account will be converted to a paid subscription unless you cancel.
  • Billing Cycle: Your subscription will automatically renew unless you cancel it before the renewal date.
  • Price Changes: We reserve the right to modify our pricing. Any price changes will be communicated to you in advance.
  • Refunds: Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms.

5. Acceptable Use

You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit any material that is defamatory, obscene, or otherwise objectionable.
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service or any server, computer, or database connected to the Service.
  • To introduce any viruses, trojan horses, worms, or other harmful material.

6. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of LandlordOne and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without the prior written consent of LandlordOne.

7. User Content

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material ("User Content"). You are responsible for the User Content that you post on or through the Service.

  • You retain ownership of your User Content.
  • By posting User Content, you grant us the right to use, modify, and display such content in connection with the Service.
  • You represent and warrant that you own or have the necessary rights to post the User Content.
  • You are solely responsible for ensuring that your User Content complies with applicable laws and regulations.

8. Data Protection

We take the protection of your data seriously. Our handling of personal information is governed by our Privacy Policy. By using the Service, you consent to our collection and use of personal information as outlined in our Privacy Policy. You are responsible for ensuring that any personal data you input into the Service (including tenant information) complies with applicable data protection laws.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LANDLORDONE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • The Service will meet your specific requirements.
  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results that may be obtained from the use of the Service will be accurate or reliable.
  • Any errors in the Service will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANDLORDONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless LandlordOne and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of and access to the Service, your violation of any term of these Terms, or your violation of any third-party right, including without limitation any copyright, property, or privacy right.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

  • Upon termination, your right to use the Service will immediately cease.
  • You may export your data before termination using our data export features.
  • We will retain your data for 90 days after termination, after which it may be permanently deleted.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
